Subject of Service

Task

Building a custom intelligent assistant based on the knowledge base provided by the Customer (PDF, site content, database).

Operation

The service includes OpenAI/Anthropic API access and hosting within the limits of the monthly fee.

Technological Limits and Liability

Due to the nature of AI technology, inaccurate answers (hallucinations) may occur.

  • The Customer is obliged to ensure the accuracy of the knowledge base.
  • The Provider is not liable for direct or indirect business damages resulting from AI-generated answers.
  • The Provider strives to achieve 95% accuracy through continuous fine-tuning.

Commitment Period

12 MONTHS FIXED TERM

Due to the maintenance of AI infrastructure, the minimum term of the contract is 12 months.

Data Protection and Security

Customer data is processed through encrypted n8n workflows. The Provider does not use the Customer's confidential data for training AI models.

Data Processing Agreement (DPA)

The Provider constitutes a data processor on behalf of the Customer and also processes end-user (third party) messages received through the chatbot. Data is forwarded to the following sub-processors to ensure the service: OpenAI Ireland Ltd. and Anthropic PBC. International data transfer to third countries (USA) is guaranteed by Standard Contractual Clauses (SCC) under GDPR Article 46. Detailed data processing conditions are contained in the DPA guidelines.

Data Retention

Chatbot conversation history and system logs are stored by the Provider during the term of the contract, but for a maximum of 6 months from the last activity. Data stored in the knowledge base is deleted upon termination of the contract.

Termination

After the commitment period, the service can be terminated by either party with a 30-day notice period, in writing (email), effective as of the last day of the calendar month.

End-User Information

It is the Customer's responsibility to inform end-users (its own clients) about the use of the AI chatbot on its own website, including updating its privacy policy in accordance with the information obligations under GDPR Articles 13 and 14. The Customer is responsible for ensuring that documents uploaded to the knowledge base do not contain unnecessary personal data.

Complaint Handling

The Customer can contact the Provider with complaints in writing via email at legal@aisolve.me. The Provider will investigate and respond to the complaint within 30 days.

14. Modification of the GTC

The Provider is entitled to unilaterally modify the GTC with at least 15 days' prior notice. If the modification affects data processing terms, the Provider is obliged to notify the Customer via e-mail.

15. Right of Withdrawal

For natural person Customers, a 14-day right of withdrawal without justification applies under relevant consumer protection laws from the date of order, unless performance has already begun with express consent.

16. Final Provisions

For issues not regulated in this GTC, the laws of Hungary and relevant international treaties shall apply.
