4. The Service

Task Scope

Delegation of operational tasks (data collection, email answering, post writing) to artificial intelligence.

5. Responsibility and Oversight

The operation of autonomous agents requires human control.

  • The Provider provides the logical framework and runtime environment of the agent.
  • The Customer is responsible for the security of external accounts (personal profiles) accessed by the agent.
  • In case of critical decisions (e.g., direct purchase), setting up human approval (human-in-the-loop) is mandatory. Implementation deadline: max 14 days.

7. Commitment Period

The rental of every agent is for a minimum of 12 months.

8. Intellectual Property

Works created by the AI agent (texts, datasets) are the property of the Customer after the relevant monthly fee has been settled.

9. Data Processing (DPA) and GDPR

Regarding data processed by Agents (e.g., Gmail, LinkedIn access), the Provider qualifies as a data processor. A valid Data Processing Agreement (DPA) is established between the parties. During its tasks, the AI Agent may access external accounts authorized by the Customer (e.g., Gmail, LinkedIn, Google Sheets). The Customer is responsible for considering a Data Protection Impact Assessment (DPIA) for its own business processes. The Provider guarantees the principle of data minimization: the Agent only accesses data essential for performing the task. Details can be found in the Privacy / DPA section.

10. Scope of Managed Data

Agents process general business data (names, emails, transaction history) to the extent necessary to perform tasks. If the Customer provides Gmail or LinkedIn access, the Agent uses this data exclusively for the dedicated tasks (e.g., email filtering, responding, profile research) and does not save or forward them for other purposes.

11. Data Retention

Email exchanges and log files are stored during the order period and until settlement between parties (max. 5 years).

12. Termination

After the commitment period, the service can be terminated in writing with a 30-day notice.

12. LinkedIn Automation Restrictions

When automating LinkedIn, the platform's Terms of Service (ToS) must be considered. The Customer acknowledges that LinkedIn strictly restricts automated activities. The Provider does its best for safe operation but does not assume responsibility for LinkedIn profile restrictions or bans resulting from automated use.

13. Legal Disputes

Parties strive for peaceful resolution, otherwise the court at the Provider's seat has jurisdiction.

Agents do not substitute for legal or financial responsibility.
